The problem doesn't happen if you use the Check Selection command that's in Spell Catcher’s Input menu, or in the Spell Catcher application's Dock menu. So that's what you're going to have to start using…
I need more details about the problem in order to file a bug report with Apple, which I'll try to find time to do over the next few days.

I have tried what you suggested and it works fine. Since it is a keyboard function I probably should have been doing this anyway. i generally use keyboard functions over menu selections for things that I do a lot. Spell Catcher spell checking is one of those and I even use it in Web windows when I type in the comments selections of the web page. I prefer my spell checking to be the same from application to application.
Yes, I have always selected "Check Selection" from the services menu (Mail, etc.) for years. I neglected to specify the way I did this was from the "Services" menu until a later post. Guess I got started this way and just kept doing it. I have been updating "Snow Leopard" and maybe the last update which I think was pretty recent changed something. I also remember a fairly recent update to Mail and maybe it started after that. I did not make the connection but likely could now. Thanks for your help and your time. Anyway, I have confirmed that this is a bug in the version of the WebKit.framework that gets installed along with Safari 5.0 and/or Mac OS X 10.6.4. Bug filed with Apple. Basically, there's no problem on 10.5.8 before installing Safari 5.0. But install Safari 5.0 from Software Update, and the black background appears.
(I needed to do a fresh install of Leopard on one of my Macs, so had the opportunity to test this at the same time)
What's happening is that the RTF produced by Mail/WebKit and placed on the Services pasteboard (with Safari 5.0) contains a \cb0 (background color) RTF control word. Previously, it did not. I couldn't find any reasonable work around for this. At least you can access Spell Catcher’s Check Selection command other ways - may not be possible for all Services that request RTF, though (Make New Sticky Note for example).
